Chemical importers entering the U.S. market in 2026 are facing a more complicated compliance environment as TSCA obligations increasingly overlap with changing tariff and customs requirements. For companies importing chemical substances, mixtures or certain articles, compliance is no longer limited to determining the correct tariff classification and paying duties. Importers must also establish that their products can legally enter the United States under the Toxic Substances Control Act (TSCA).
EPA states that chemical imports must either receive a positive TSCA certification confirming compliance with applicable TSCA requirements or, where appropriate, a negative certification confirming that the shipment is not subject to TSCA. Certifications are generally filed through U.S. Customs and Border Protection's Automated Commercial Environment (ACE).
The result is a two-track compliance challenge: tariff exposure affects the cost of an import, while TSCA compliance determines whether the chemical can legally enter the market.
The overlap between trade and chemical regulation has become particularly important in 2026 as companies manage tariff changes, customs scrutiny and evolving EPA requirements at the same time.
The U.S. government has also increased its focus on customs and trade enforcement. A July 2026 DOJ and DHS resource guide emphasizes enforcement against false declarations, smuggling and other conduct that can undermine tariff collection and allow restricted goods to enter U.S. commerce.
For chemical importers, this means information supplied to customs must be accurate across multiple dimensions, including:

TSCA Section 13 requires importers to certify that chemical shipments comply with applicable TSCA requirements. A positive certification states that the chemicals comply with applicable TSCA rules and orders.
A negative certification is used when the chemicals are not subject to TSCA.
Importers should therefore establish TSCA status before shipment rather than treating certification as a final customs-documentation exercise.
One of the most important TSCA considerations is that importing a chemical can constitute "manufacture" under TSCA.
For a new chemical substance that is not already on the TSCA Inventory and does not qualify for an applicable exemption, the importer may need to submit a Premanufacture Notice (PMN) at least 90 days before beginning non-exempt commercial importation. Similar requirements can apply to significant new uses through Significant New Use Notices (SNUNs).
This creates a major planning difference from tariff compliance.
A tariff change may affect a shipment shortly before entry, whereas a TSCA requirement can determine whether the import can proceed at all unless the necessary EPA process has already been completed.
Importers should also be aware that EPA extended the deadline for reporting certain health and safety information under TSCA Section 8(d).
In May 2026, EPA finalized a one-year extension, moving the reporting deadline for the covered chemicals from May 22, 2026, to May 21, 2027. The rule applies to manufacturers, including importers, of the 16 chemical substances covered by the reporting rule.
This does not remove the reporting obligation. Instead, it gives affected companies additional time to prepare submissions while EPA considers possible changes to the rule.
For importers with affected substances, the new 2027 deadline should therefore be added to their compliance calendars rather than treated as a cancellation of the requirement.
Chemical importers can organize their 2026 compliance activities around five major checkpoints.
Before a shipment leaves the supplier, confirm:
Chemical identity and CAS number
TSCA Inventory status
Applicable Section 5 requirements
Existing Section 6 restrictions
Section 5(e) orders or Significant New Use Rules
Whether the product qualifies for an exemption
Required TSCA certification
EPA's import guidance specifically notes that positive certification covers applicable TSCA Sections 5, 6 and 7 requirements and Title IV rules.
The customs team should separately verify:
HTS classification
Country of origin
Customs valuation
Current tariff rate
Applicable exclusions or exemptions
Additional duties or trade measures
Required entry documentation
This is where tariff compliance intersects with chemical compliance. The same commercial invoice and product description may feed both customs and regulatory workflows, so inconsistencies can create unnecessary scrutiny.
For new substances, regulatory teams should begin TSCA analysis well before the intended import date.
The 90-day PMN requirement means companies cannot safely wait until a shipment is booked to determine whether the substance can be imported.
Companies covered by EPA's Section 8(d) Health and Safety Data Reporting Rule should use the remainder of 2026 to identify relevant studies and prepare their submissions ahead of the May 21, 2027 deadline.
EPA continues to propose new Significant New Use Rules and other TSCA actions. A July 2026 proposed rule, for example, would require notification to EPA at least 90 days before certain activities designated as significant new uses could begin if the proposal is finalized.
This makes continuous regulatory monitoring particularly important for chemical importers with frequently changing product portfolios.
The biggest risk occurs when companies treat customs and environmental compliance as separate systems.
Consider a chemical imported from Asia.
The procurement team determines the supplier price and shipping cost. The customs team calculates the applicable tariff. Meanwhile, the regulatory team must determine whether the substance is listed on the TSCA Inventory and whether any restrictions apply.
If the product description, chemical identity or intended use differs between these records, the company could face questions from both customs and EPA-related compliance teams.
A strong import workflow therefore connects procurement → product data → regulatory review → customs classification → tariff calculation → TSCA certification → shipment release.
For companies managing hundreds or thousands of chemical SKUs, manual checking becomes increasingly difficult.

For chemical companies, this means regulatory compliance should be incorporated into landed-cost calculations and sourcing decisions, not added after the purchase order has already been issued.
The 2026 compliance environment is creating a new reality for chemical importers: trade compliance and chemical regulatory compliance are becoming increasingly interconnected.
Tariff schedules can change the economics of sourcing from one country versus another, while TSCA requirements can determine whether a particular chemical can enter the U.S. market in the first place.
The companies best positioned to manage this environment will be those that build a single compliance workflow linking chemical identity, TSCA status, customs classification, tariffs, supplier documentation and shipment data.
For chemical procurement teams, the key lesson is simple: do not calculate the landed cost before calculating regulatory eligibility. In 2026, the cheapest chemical on paper may not be the cheapest chemical that can legally and efficiently reach the U.S. customer.
